Public Interest Disclosures Act 2022 template contract clauses now available

Section 82(2) of the Public Interest Disclosures Act 2022 (PID Act) comes into effect 1 October 2023.

To comply with section 82(2) of the Public Interest Disclosures Act 2022 (PID Act), NSW Government agencies can use the template contract clauses DOCX, 47.09 KB.

The clauses may be used when engaging entities or contractors to:

  • provide services on behalf of an agency or
  • exercise the functions of the agency under s81(3) of the PID Act.

Under section 82(2) of the PID Act, an agency, a person exercising the functions of an agency, or a head contractor cannot engage a contractor to provide services on behalf of the agency unless the contract contains specific clauses relating to PIDs.

This requirement applies to to all service contracts entered into by an agency from 1 October 2023.

The NSW Ombudsman’s Office and NSW Treasury have jointly developed the clauses.
