New Procurement Board Direction 2024-02 Increasing opportunities for local suppliers to supply to government

NSW Government agencies must consider local suppliers in their government procurement processes.

On 3 September 2024 the Minister for Domestic Manufacturing and Government Procurement directed the NSW Procurement Board to issue Procurement Board Direction 2024-02 Increasing opportunities for local suppliers to supply to government.

The Procurement Board approved and published PBD 2024-02 on 9 September 2024.

Agencies are required to implement the direction promptly, but no later than 1 January 2025.

The provisions in the board direction apply to procurements of all goods, services or construction valued $7.5 million or more.

Agencies are required to:

  • check if any NSW-based suppliers can supply the needed goods or services
  • provide NSW-based suppliers with full and fair opportunity to participate in the procurement
  • explain, when awarding the contract, why a local supplier was not chosen if there was one available.

Agencies must report quarterly to the Procurement Board on how they are implementing this direction.

NSW Procurement will publish implementation guidance to agencies by the end of September 2024.

Additional guidance and reporting requirements will be confirmed and published following consultation with agencies.

The Minister has also directed that agencies must update their procurement frameworks to give effect to the board direction by 15 December 2024. This includes updates to all relevant policies, procedures, standards and guidance materials.
