This privacy statement applies to visitors, users, buyers and suppliers of buy.nsw (the site), which is managed by NSW Treasury (we, us, our). It governs personal information captured through buy.nsw.

buy.nsw will treat the information we collect from visitors, users, buyers and suppliers within the terms of the NSW Government’s privacy responsibilities and obligations. The NSW Government’s privacy practices are regulated by the New South Wales Privacy and Personal Information Protection Act 1998.

We respect the privacy and personal information of the visitors, users, buyers and suppliers of the site. We will use all personal information we collect to improve the buy.nsw site and its information and services offering.

All visitors, users, buyers and suppliers agree to respect the privacy and personal information of others. See the Terms of use for more information on your agreement to act in a way that is lawful and ethical.

Information we collect

Visiting buy.nsw

When you look at the pages on this site, our network automatically records information that identifies, for each page accessed:

  • the address of your service
  • the IP (Internet Protocol) of the machine which has accessed it
  • the type of browser and operating system you have used
  • the pages accessed and documents downloaded
  • the date and time of your visit to the site.

Purpose of collection

We aggregate the information we collect during each visit with similar logged information and publish reports that help us identify patterns of site usage. This helps us improve the site and its information and services offering.

Disclosure of information

We will not disclose or publish information that identifies individual’s computers, or potentially identifies sub-groupings of addresses, without consent or otherwise in accordance with the New South Wales Privacy and Personal Information Protection Act 1988.

Creating a user account

This privacy notice applies to the personal information we collect when you create a user account on buy.nsw.

When you create a buy.nsw user account, we will ask you to provide a name and email address.

Purpose of collection

We collect your email address and name to create your log in details, and to contact you about your account.

You may also select to receive additional information from us. If so, we will use your name and email address to send you information about procurement in NSW Government, such as news about tenders, schemes, panels and policies.

Disclosure of information

The email address and name collected from users is visible to our staff and may be shared with other NSW Government procurement systems.

Registering as a buyer

This privacy notice applies to the personal information we collect when you register as a buyer.

We collect the following personal information on buyers:

  • your name (first name and surname) and email address
  • contact number (optional)
  • manager’s name (first name and surname) and email address (optional)
  • data relating to the name or email held on other NSW Government systems.

Buyers are responsible for ensuring they obtain consent from their manager before providing their name and email address to us.

Purpose of collection

We collect these details to:

  • facilitate communications between ourselves and buyers
  • confirm that the buyer is an eligible NSW Government or non-government buyer.

Disclosure of information

The personal information collected from buyers is visible to our staff and may be shared with other NSW Government procurement systems. It is not shared with suppliers.

Registering as a supplier

This privacy notice applies to the personal information we collect when you apply as a supplier.

We collect the following personal information on suppliers:

  • the name (first name and surname), email address and phone number of each supplier’s authorised representative
  • the name (first name and surname), email address and phone number of each supplier’s business contact
  • personal information contained in documents provided as part of supplier registration
  • data relating to the supplier ABN held on other systems
  • data relating to the business contact and authorised representative held on other systems.

Suppliers are responsible for ensuring they obtain the consent of any individuals involved, before providing their personal information to DCS.

Collection of sensitive information from suppliers

We may also collect personal information in relation to legal and financial disclosures when you register as a supplier. This may include sensitive information, such as:

  • information about membership of political associations
  • health information provided as part of legal disclosures
  • information about criminal convictions provided as part of legal disclosure.

Purpose of collection

We collect these details to:

  • confirm your organisation meets the basic requirements to work with NSW Government
  • confirm the information you provide about your organisation is correct, complete and current
  • promote suppliers to buyers
  • facilitate communications between ourselves and suppliers
  • facilitate communications between buyers with suppliers
  • assist buyers to perform due diligence.

Disclosure of information

The personal information collected from suppliers is visible to NSW Government staff and may be shared with other NSW Government procurement systems. Some information is visible on your supplier profile. However, sensitive information is only accessible at the request of a registered buyer.

Providing feedback

Visitors and users can give feedback on buy.nsw directly from the site. As part of providing feedback you may be required to provide your personal details. We may also from time to time survey buyers and suppliers about their experiences using buy.nsw

Purpose of collection

We use feedback and survey results to further develop and improve the site. This information will only be used for the purposes for which it was provided.

Disclosure of information

We will not disclose any personal information you provide when giving feedback. Any aggregated information about feedback that we publish on the site will not identify individual visitors and users.

How we collect information

Forms

Information is collected on buy.nsw using online forms. Online forms contain text fields, tick boxes, radio buttons and other metadata and are designed to collect the most appropriate and relevant information. All forms on buy.nsw include text, which describes why we need the information we are collecting and what we will use it for.

Application program interface (API)

An API is a set of clearly defined methods of communication among various web-based components, which allow buy.nsw to access the data of external systems, applications, and services. We use APIs to validate information you provide, and ensure the data held in NSW Government procurement systems is consistent, correct, complete and current.

Cookies

Cookies are small pieces of text data that a web server can store, and later retrieve from a visitor or user's computer. They do not personally identify you but do identify your browser. This site uses cookies that can be either persistent or session based.

  • Persistent cookies are stored on your computer. They contain an expiration date and may be used to track your browsing behaviour upon return to the issuing website.
  • Session cookies are short-lived. They are used only during a browsing session and expire when you shut down your browser.

We use cookies to record your preferences in relation to your use of the site. We also use cookies that allow us to recognise your browser if you return to this site in the future. This will allow NSW Treasury to present information that may be most relevant to you based on your previous visits. This also helps us to understand what parts of the site visitors and users find the most useful, to improve the effectiveness of the site.

The cookies on this site do not read the information on your hard drive. They do not make your computer perform any actions or make your computer send information to any other computer via the internet.

You may refuse the use of cookies by selecting the appropriate settings on your browser. However, this may affect the full functionality of the site.

Google Analytics

Our website uses Google Analytics, a service which transmits website traffic data to Google servers in the United States. Google Analytics does not identify individual users or associate individual IP addresses with any other data held by Google. We use reports provided by Google Analytics to help us understand website traffic and webpage use. For information about this, see Google's Privacy Policy. You can opt out of Google Analytics if you disable or refuse the cookie, disable JavaScript, or use the opt-out service provided by Google.

How we protect personal information

We store and archive information we collect on the site in an appropriately secure format. To help protect the privacy of data and personal information we collect and hold, we maintain appropriate physical, technical and administrative safeguards. We delete information when it is no longer required for the purposes for which it was collected.

Exceptions

We will collect, use and disclose more extensive information than stated above in the following circumstances:

  • unauthorised attempts to access files which are not published on the buy.nsw pages
  • unauthorised tampering or interference with files published on the site
  • unauthorised attempts to index the contents of the site by other sites
  • attempts to intercept messages of other users of the site
  • communications which are defamatory, abusive, vilify individuals or groups or which give rise to a suspicion that an offence is being committed
  • attempts to otherwise compromise the security of the web server, breach the laws of the State of New South Wales or Commonwealth of Australia, or interfere with the enjoyment of the site by other users.

We reserve the right to make disclosures to relevant internal and external authorities where the use of this site raises a suspicion that an offence is being, or has been, committed.

In the event of an investigation, we will provide access to data to any law enforcement agency that may execute a warrant to inspect our logs.

Updates

This privacy statement may be modified or expanded to accommodate new developments or issues that may arise from time to time. Any such changes will take effect when we publish this page. We will email users of any substantial changes.
